Terms & Conditions

1. Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Your account

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized access at support@hexx.co.

3. Subscriptions and payments

• The Service offers free credits and paid subscription plans. Available plans, pricing, and features are described in the app.
• Subscriptions purchased through the Apple App Store or Google Play are billed and managed by the respective platform under that platform's terms.
• Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Cancellation removes future renewals; you retain access for the remainder of the current billing period.
• Refunds are handled by the platform that processed your payment, in accordance with that platform's policies. We do not offer cash refunds outside of those policies.

4. Acceptable use

You agree not to use the Service to:

• generate, upload, or distribute content that depicts child sexual abuse, real-world violence, terrorism, or other unlawful activity;
• generate sexually explicit imagery of any identifiable real person without that person's verifiable, ongoing consent, or of any minor;
• create deceptive content (such as synthetic images of real people designed to deceive viewers about real-world events) intended to harass, defame, threaten, defraud, or impersonate;
• infringe intellectual-property, publicity, or other rights of any third party;
• harass, threaten, dox, or facilitate violence against any individual or group;
• attempt to bypass safety filters, rate limits, or technical protections;
• reverse engineer, decompile, scrape, or build a competing service from the Service;
• use automated means to access the Service except as permitted by published APIs.

You are solely responsible for the content you upload and generate. For any photo or likeness used as an input, you represent that you have the necessary rights and consents from any identifiable individual depicted.

5. Your content and license

Inputs.You retain ownership of the photos, videos, and prompts you submit (“Inputs”). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, transmit, and display your Inputs solely to operate, secure, and support the Service. We do not use your Inputs to train general-purpose AI models without your separate consent.

Outputs.Subject to your compliance with these Terms, you may use the photos and videos generated for you (“Outputs”) for personal use and, on paid plans, commercial use. You acknowledge that:

• Outputs may resemble other content; we do not warrant uniqueness, originality, or non-infringement.
• Outputs are not necessarily eligible for copyright protection in every jurisdiction.
• You are solely responsible for how you use Outputs.

If you choose to share an Output publicly (for example, by posting to the in-app community feed), you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, and promote that Output as part of the Service. You may withdraw a public Output at any time, and we will remove it from places we control within a reasonable period.

6. Our intellectual property

The Service, including all software, designs, graphics, text, and trademarks (excluding your Inputs and Outputs), is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose subject to these Terms.

7. Feedback

If you submit ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

8. Privacy

Our Privacy Policy explains how we handle personal information. By using the Service you consent to that handling.

9. Termination and suspension

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS. AI-GENERATED CONTENT MAY CONTAIN ERRORS, ARTIFACTS, OR UNEXPECTED RESEMBLANCES TO EXISTING WORKS OR PEOPLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTRINSIC THINKING, INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

12. Indemnification

You agree to indemnify and hold harmless Intrinsic Thinking, Inc. and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your Inputs, (b) your use of Outputs, (c) your violation of these Terms, or (d) your violation of any third-party right, including any privacy or intellectual-property right.

13. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to support@hexx.co. We will respond as required by applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the State of [State of Incorporation], United States, without regard to conflict-of-laws principles. Subject to applicable consumer-protection laws, any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in [County, State], and the parties consent to personal jurisdiction there. 15. Changes to these Terms

We may update these Terms. If changes are material, we will provide reasonable notice (for example, in-app or by email). Your continued use of the Service after changes take effect constitutes acceptance.

16. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
